Limits of the GVRO and Other Types of Restraining Orders

A Gun Violence Restraining Order will NOT order the restrained person to:

  • Stay away from you or your family members
  • Not contact or go near you, your children, other relatives, or others who live with you
  • Move out of your house

If you are being threatened, stalked, harassed, or sexually or physically abused by someone, you may be able to obtain a restraining order to protect you.

Five of the most common restraining orders in California include:

  • Emergency Protective Orders: Local law enforcement can request an emergency protective order if a victim is at risk of imminent harm or danger
  • Domestic Violence Restraining Orders: Protection for victims of domestic violence if the victim and his or her abuser are in a domestic relationship or are closely related
  • Civil Harassment Restraining Orders: When the relationship between the victim, abuser, stalker, or harasser is not considered to be in a domestic relationship
  • Elder/Dependent Adult Abuse Restraining Order: If the victim is 65 or older, or between 18-64 and a dependent adult
  • Workplace Violence Restraining Order: Filed by an employer to protect an employee from violence, stalking, or harassment by another person
