Business Organics & Food Waste Recycling Program

Effective January 1, 2022, all California residences and businesses are required to separate organic waste from other trash and non-organic recyclables and participate in an organic waste collection program. For more information on the legislation, visit the Irvine SB 1383 webpage.

In addition, food service businesses must donate surplus edible food to food recovery organizations.

Food Recovery Requirements

There are two groups of large edible food generators that are defined in SB 1383 that must have a written food recovery agreement with a food recovery organization.

Tier 1 Commercial Edible Food Generators includes the following:

  • Supermarkets
  • Grocery stores larger than 10,000+ square feet
  • Food service providers
  • Food distributors
  • Wholesale food vendors

Tier 2 Commercial Edible Food Generators include:

  • Restaurants with facilities ≥ 5,000 sq. ft. or 250+ seats
  • Hotels with an on-site food facility with 200+ rooms or a restaurant with 250+ seats
  • Health facilities with an on-site food facility and 100+ beds
  • Venues that seat 2,000+ people
  • Events that serve an average of 2,000 visitors per day
  • State agency cafeterias with facilities ≥ 5,000 sq. ft. or 250+ seats
  • Local education agencies with an on-site food facility
  • Non-local entities, such as public universities and community colleges

Nonexclusive Solid Waste Haulers 

The following list of solid waste haulers is available to businesses in the nonexclusive commercial areas. Please check the waste hauler map to see if your business is located in the nonexclusive commercial areas (purple zone on the map). Businesses located in the exclusive village commercial area (yellow zone on the map) are required to receive solid waste and recycling services from Waste Management.

Additional Information

Certain commercial businesses may qualify for waivers from these mandatory program requirements. Only businesses that have requested and received a waiver from the City are exempt from mandated participation in organic waste recycling programs through a franchise-hauler program.
